By creating an account or using the Services, you agree to these Terms.
1. Eligibility
You must be at least 18 years old and legally authorized to represent your business to use the Services.
2. Account Registration
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for all activity that occurs under your account.
- You agree to provide accurate business and contact information.
3. Subscription Plans and Billing
- Services are offered under Free, ₹499/month, and ₹1,499/month plans (or as listed on our Pricing page).
- Paid plans are billed monthly/annually in advance, as selected at checkout.
- We reserve the right to change pricing with prior notice of at least 30 days to existing subscribers.
4. Free Trial
- Free tier / trial access is provided as described on our pricing page and is subject to usage limits (e.g., member count caps).
- We reserve the right to modify or discontinue free tier limits with notice.
5. Cancellation
- You may cancel your subscription at any time from your account dashboard or by emailing contact@brilliants.in.
- Cancellation stops future billing; it does not automatically entitle you to a refund for the current billing period (see Refund & Cancellation Policy).
6. Acceptable Use
You agree not to:
- Use the Services for any unlawful purpose
- Attempt to reverse-engineer, copy, or resell our software
- Upload malicious code or attempt to breach system security
- Use the Services to store or process data you do not have the legal right to process (e.g., biometric data without employee/member consent)
7. Your Data
- You retain ownership of all business data you input into the Services (member records, employee data, invoices, etc.).
- You are responsible for obtaining necessary consents from your employees/members/customers before entering their personal or biometric data into our systems.
- We act as a data processor for this data as described in our Privacy Policy.
8. Intellectual Property
All software, branding, designs, and content on brilliants.in and within our products are owned by Brilliants and may not be copied, reproduced, or redistributed without written permission.
9. Service Availability
- We aim for high uptime but do not guarantee uninterrupted, error-free service.
- Scheduled maintenance will be communicated in advance where possible.
- Offline functionality (where available) is designed to sync data once connectivity is restored, but we are not liable for data conflicts arising from prolonged offline use.
10. Limitation of Liability
To the maximum extent permitted by law, Brilliants shall not be liable for indirect, incidental, or consequential damages arising from use of the Services, including but not limited to business losses, data loss, or lost profits, except where caused by our gross negligence or willful misconduct.
11. Termination
We may suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or fail to pay applicable fees, with notice where reasonably possible.
12. Governing Law
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts at Wardha, Maharashtra.
13. Changes to Terms
We may update these Terms from time to time. Continued use of the Services after changes constitutes acceptance of the updated Terms.
